For the purposes of the Drug and Alcohol Testing Policy, a prohibited substance is a controlled substance listed in section 802(26A) of the Fair Labor Standards Act of 1938, as amended, or other similar law, but does not include drugs listed in schedule II of the Controlled Substances Act. The document was written assuming that employees will only be tested for non-prescribed prescription drugs. However, the author realizes that this assumption may not be correct. Some legal exceptions or circumstances under which prescription drugs may be tested include situations where the employee's job requires frequent or frequent contact.
